Boring but necessary

1. Definitions
In these terms and conditions of sale, the following terms have the meanings indicated:
a) “Business Day” means Monday to Friday 9am – 5pm excluding public Holidays
b) “EFT” means electronic funds transfer
c) “Sale Price” means the price we quoted for sale of the trailer to you and that you accept.
d) “Trailer” means the Blue Tongue, SWAG, Nomadic or Marlin Trailer and all the components/accessories advertised for each model.
e) “We”, “Us” or “Our” means Catmar Enterprises Pty Ltd T/as Camper Trailer Sales SA. ABN 59 636 917 265
f) “You” or “Your” means the person who purchases a trailer from us (and if more than one, all persons or entity)
 

2. Terms & Conditions
Your purchase of a trailer is made subject to these terms and conditions:
 

3. Sales Contract
a) We agree to sell the Customer and the Customer agrees to purchase from us the Trailer specified in the Invoice (Contract) on the terms and conditions set out below and subject to any variations listed on the invoice.
b) These terms including any amendments thereto comprise the entire agreement between the Parties regarding the sale of the Trailer and supersede any previous terms and conditions, representations, agreements or arrangements between the Parties in relation to the sale of the trailer
 

4. Acceptance
The buyer is taken to have exclusively accepted and is immediately bound, jointly and severally, by these terms and conditions if the Buyer places and order and pays a deposit for and/or accepts delivery of the goods. You also agree to the warranty terms and refund policies once a deposit is made.
 

5. Deposit
Generally, a $2000 deposit is required when you agree to purchase a trailer from us. Cancellation after 7 days (14 days when subject to finance) will result in your deposit being forfeited. The deposit also “Locks in the price” of the trailer from that day until such time as the trailer is delivered to you and the outstanding balance is paid.

6. Payment
1st Payment - $2000 deposit to order
2nd Payment – 30% invoice balance as soon as the trailer arrives in the country, and we have notified you of the delivery. We will not ask you for this progress payment unless a Vin Number is provided.
Final Payment –Balance of invoice upon collection and handover as cleared funds in the nominated bank account listed on your invoice.
Non-Payment within the requested time frame may result in delays or the forfeiting of your deposit.
Credit card payment will attract an additional 2% surcharge. Amex and Diners Club cards are not accepted.
 

7. Refunds of Deposits
We will always strive to meet timeframes however given the complexity of importing goods into the country will not refund deposits because of:
a) Customer changing their mind or cancellation due to circumstances
b) Delayed shipping or international shipping faults and port congestions
c) Supply issued due to international shipping
d) Delays because of COVID related government measures.
e) Delays beyond our reasonable control. Examples: Flood, Pandemic, war etc.
 

8. No Liability for delay
If the trailer is not available by the estimated delivery date, we will not be liable to compensate you for any costs or damages claimed by you because of the delay in the delivery of your trailer.
 

9. Supply Chain
Due to massive surge in product demand, we may not be able to supply items that are coming from 3rd party suppliers such as fridges etc on the day of handover. Alternative products may be installed.
 

10. Collection of Trailer
Must be arranged on a Business Day. We do not do handovers on Weekends or Public Holidays.
You must have a suitable tow vehicle with correctly fitted electronic brakes.
